What is the Loophole, and why does it matter?

New Jersey’s Garden State Film and Digital Media Jobs Act gives tax credits to attract film and digital media productions to New Jersey. To get the tax credit, producers must spend a certain amount on hiring in-state workers, like stagehands, drivers, directors and actors.

The Loophole lets the producers take the tax breaks and then hire low-paid musicians in Central and Eastern Europe to make the music, completely bypassing the thousands of domestic professional musicians – including NJ-based musicians – who should be getting that work.

The solution: Close the Loophole

S. 4392 and A. 4382 in the NJ legislature amend the Act to end the outsourcing of musical scoring work overseas while taking NJ tax dollars — ensuring that our musicians on this side of the ocean — not underpaid foreign musicians across the Atlantic — have fair access to the employment.
